REFUND AND RETURN POLICY

1. GENERAL PROVISIONS
3DMODELTRADE (“Company”, “we”, “our”, “us”) provides this Refund and Return Policy (“Policy”) to clarify the terms and conditions regarding refunds and returns for digital products purchased through our Service at 3dmodeltrade.com and its subdomains.
This Policy is an integral part of our Terms of Use. By purchasing any digital products from our Service, you acknowledge that you have read, understood, and agree to be bound by this Policy.
2. DIGITAL PRODUCTS AND NON-REFUNDABLE NATURE
2.1 Definition of Digital Products
Digital Products refer to all 3D models, textures, assets, and any other downloadable digital content available on our Service. These products are delivered electronically and do not have a physical form.
2.2 Non-Refundable Nature of Digital Products
Due to the nature of digital products, all sales on 3dmodeltrade.com are considered FINAL. Once a digital product has been purchased and the download has been made available to you, no refunds will be provided except in limited circumstances as outlined in Section 3 of this Policy.
This non-refundable policy is in accordance with applicable laws regarding digital content, including but not limited to:
- European Union: Under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal (14-day cooling-off period) does not apply to “the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and their acknowledgment that they thereby lose their right of withdrawal.”
- United States: While the U.S. lacks a unified federal regulation on digital product returns, our policy is consistent with common industry practices permitted under state consumer protection laws, including California’s Automatic Renewal Law (ARL) and similar regulations.
- Turkey: In accordance with Article 15 of Turkey’s Consumer Protection Law No. 6502 and the Distance Contracts Regulation, consumers lose their right of withdrawal for digital content not supplied on a tangible medium once the performance has begun with the consumer’s prior express consent.
3. LIMITED EXCEPTIONS FOR REFUNDS
Despite the non-refundable nature of our digital products, we may, at our sole discretion, consider refund requests in the following limited circumstances:
3.1 Technical Defects
If the purchased digital product contains significant technical defects that substantially impair its usability and these defects cannot be resolved through our customer support within a reasonable timeframe, we may issue a full or partial refund.
3.2 Product Misrepresentation
If the product description substantially misrepresents the actual product (e.g., incorrectly stated polygon count, file formats, or key features), we may issue a full or partial refund.
3.3 Unauthorized Purchases
In cases of verified fraudulent or unauthorized purchases, we will cooperate with law enforcement and financial institutions and may issue refunds as required by applicable law.
4. REFUND REQUEST PROCESS
If you believe your situation falls under one of the limited exceptions outlined in Section 3, you may submit a refund request as follows:
- Send an email to support@3dmodeltrade.com with the subject line “Refund Request – [Order Number]”
- Include detailed information about the purchase, the reason for the refund request, and any relevant supporting documentation
- Submit your request within 7 days of purchase
We will review your request and respond within 10 business days. Any approved refunds will be processed using the original payment method whenever possible.
5. CHARGEBACKS AND PAYMENT DISPUTES
Filing a chargeback or payment dispute with your payment provider without first attempting to resolve the issue through our refund request process is strongly discouraged. In case of an unjustified chargeback:
- Your account may be suspended or terminated
- You may be liable for any fees incurred by the Company as a result of the chargeback
- You may be banned from future purchases
6. SUBSCRIPTION SERVICES
For any subscription-based services we may offer:
- You may cancel your subscription at any time
- No refunds will be provided for the current billing period
- Cancellation will take effect at the end of the current billing period
- You will continue to have access to subscription benefits until the end of the current billing period
7. STATUTORY RIGHTS
Nothing in this Policy affects your statutory rights that cannot be waived under applicable law. In jurisdictions where certain refund rights for digital products are mandated by law and cannot be waived, those provisions will apply to the extent required.
7.1 European Union Customers
For customers in the EU, please note that while the right of withdrawal generally does not apply to digital products as described above, if you have not yet downloaded or accessed the digital content, you may retain your 14-day right of withdrawal in accordance with the EU Consumer Rights Directive.
7.2 Turkish Customers
For customers in Turkey, in accordance with the Distance Contracts Regulation, your right of withdrawal does not apply once you have accessed the digital content, provided you have given your express consent and acknowledgment of losing this right before accessing the content.
8. AMENDMENTS TO THIS POLICY
We reserve the right to modify this Policy at any time by posting the amended Policy on our website. Your continued use of our Service following the posting of changes constitutes your acceptance of such changes.
